The Grand Prize - What does the winning band receive?

The winning band will receive a promotional package sponsored by the LI Podcast Network including:

• A podcast dedicated specifically to the winning band, with at least 5 of their songs.
• The LI Podcast Network will video podcast one of the winning bands live or studio performances and distribute it to over 10 video web sites including YouTube, Flix55.com, Magnify, Red Lasso, and more.
• A free commercial promoting the winning bands CDs or gigs on LongIslandOnlineRadio.com and its affiliate networks
• Distribution of their music to over 100 music podcasters around the world

You can register to have your music podcasted for free. If you choose to enter the Battle of the Bands Podcast Competition, you must also do the following:

Get Votes! Email your fans, following, mailing list, Myspace friends, promoters, EVERYONE and tell them to vote for you. You simply need to place this banner on your Myspace page, web site, blog, and as many places as you can and get votes:

1. Send voters to vote for you on our Myspace page at http://www.myspace.com/lipodcast by leaving comments telling others to vote for your band. Myspace comment votes count double. Only votes from comments at our Myspace page at http://www.myspace.com/lipodcast will count double.
2. Get people to DIGG the above article and make sure your voters leave a comment on the Digg page telling others why you should win and how much they love your music. DIGG votes count triple. They must DIGG the above article and leave a comment.

1. We will podcast your band for two weeks between April 27 and November 2, 2008.
2. In that 2 week period, you will be able to get as many votes as possible.
3. Voting for your band and the podcast of your music will close for your band after the two weeks.
4. On November 2, voting will open back up for ALL bands for 2 more weeks until November 16, 2008.
5. The 5 acts with the highest number of votes will appear on one final podcast.
6. Our panel of judges will vote on their favorite act. Every judge will vote the final 5 bands on a scale of 1 to 10 for a maximum possible total of 50 points. The band with the highest score will win.

THE LONG ISLAND PODCAST NETWORK OFFICIAL RULES AND DETAILS OF BAND ENTRY and VOTER REGISTRATION 1. ELIGIBILITY: The Battle of the Bands Podcast Competition ("Competition") is only offered and open to musical bands, members must be legal residents of, and residing in, the United States and are at least eighteen years old at time of entry. Employees, officers and directors of Hot Web Ideas, Inc. and Long Island Podcast Network.com ("Sponsor" or "LIPN"), its respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, web masters and web suppliers and their respective immediate family members (parents, spouse, children or siblings) and persons living in the same household (whether or not related) of such employees, officers or directors are not eligible. Any band members either as individuals in a band, or bands, which are under contract to any music or entertainment production or related company, promoter, producer, or agent, are eligible for participation. By entering the Competition, each participant agrees to be bound by these Official Rules and the decisions of the Sponsor and/or the judges which are final and binding in all respects. This Competition is void where prohibited. 2. TO PARTICIPATE: (A) Registration: Between 4/27/08 at 12:01 a.m. Eastern Time ("ET") and 10/31/2008 at 11:59:59 p.m. ET access the LIPN LIpodcastnetwork.com web site ("web site") and click on the icon, banner or text link to access the Competition registration page. On that page bands must complete the following information fields: Band Contact Information (country, state, city, band email address, band web page, street address, zip code, genre, song title entered in the competition, web address where LIPN can download the MP3 of the song as specified in the Entry Materials) Band Member Contact Information (First name, last name, birth date, gender, contact email address, role in band (must be a band performer or band’s manager), home phone number and mobile phone number) Web Site Membership Information (username and password) Note: Each time you visit the web site to participate in the Competition, the band must log-in using the band’s username and password. If at any time a username or password is forgotten follow the instructions and the username or password will be emailed to the band’s contact member. Each band is solely responsible for the security of its username and password. Precautions should be taken to keep usernames and passwords private to prevent unauthorized use. Neither Sponsor, nor any other person or entity will be responsible for any losses, damages or consequences suffered due to careless or unauthorized use of a username and password. Only one username and password may be used by any band. Only the required fields must be completed. Any optional fields need not be completed. (B) About the Bands: Once a band is registered it cannot re-register under a different name of other identity. All band members must meet all of the eligibility requirements. No member of any band may be a member of any other band. No member of any band can be substituted or changed. Should a band member of any band leave that band for any reason whatsoever, (except for the death of a band member, or the injury or disability of a band member sufficient in the sole opinion of Sponsor to preclude that band member from participating in the Competition) the band can only proceed in the Competition with the remaining band members except in the case of the stated death or injury or disability of a band member, and in which case, the person who replaces the band member must (a) meet all eligibility requirements, (b) agree to these Official Rules, (c) perform with the same instrument(s) as the replaced band member, and (d) cannot be replaced except only as provided in these Official Rules. The first band member ("Contact #1") listed on the registration page shall be that band’s contact member who will receive all information and notifications for the Competition and who will be responsible for the dissemination of information and notifications to the remaining band members. Information and notifications shall be transmitted to the band contact member by mail, email, phone, overnight mail (or in any manner determined by Sponsor). It is the sole responsibility of each band to maintain its contact information current. Should a band wish to change its contact member it may do so by logging onto the web site, accessing its profile as instructed and changing that information. When the registration information is submitted, the designated band contact person will receive an email confirming the band username and password, and will contain instructions on the procedure to follow to upload or otherwise submit (as permitted in these Rules) the band Entry Materials. (C) Entry Materials: Bands (a) may submit a link via the LIPN website to one and only one song of no more than 5 MB in MP3 format, or band may mail-in an audio only CD with a song with the same parameters, and the song must be performed only by band members, (b) in the text box provided the band may (but will not be required to do so) submit a band biography/profile of no more than 250 words, and the biography/profile and, Should a band elect to mail-in an audio CD, that CD must be mailed in a first class mail or overnight mail to PO Box 2058, North Babylon, New York 11703, postmarked by the day a band registers, for receipt not later than the date prior to the band being podcasted. Proof of mailing is not proof of receipt. The CD must have written clearly and neatly directly on the CD the name of the band, and the name, address, phone number, and email address of the band’s contact member. Once a band submits its Entry Materials the Entry Materials submitted (but not the content thereof) become the sole property of Sponsor, and will not be acknowledged or returned. It is recommended that each band retain copies of its Entry Materials. Any Entry Materials which Sponsor, in its sole opinion, deems to be inappropriate for publication will not be considered and the band submitting those materials will be disqualified. By entering, each band and each member of that band warrants and represents that all of the Entry Materials (and all music performed during any Competition performance) (i) is/will be the sole and original creation of the band (or an individual member of the band who has given permission to use to the band) and has not been copied in whole or in part from any other work; (ii) does not/will not violate or infringe any intellectual property right, such as but not limited to, copyright, trademark/trade name, or contract rights, or other proprietary right of any person (including but not limited to rights of privacy or publicity and are not defamatory, slanderous or libelous, or portray in a false light), or entity; (iii) is/will be the sole and exclusive property of the band (or an individual member of the band who has given permission to use to the band); (iv) is not licensed or otherwise encumbered in any manner whatsoever; and (v) complies with (and does not violate) any law, rule or regulation. Entry Materials cannot name, describe, or depict any person or character, living or dead or fictional, except only the band members, and cannot contain any material subject to copyright of any third party or contain the trademark, trade name or logo of any third party (other than that which is displayed on an instrument and applied to that instrument by its manufacturer and then only as it had been applied by the manufacturer). By entering, the band grants permission for the use of the Entry Materials, and name of the band (and the name of each individual member of the band), in connection with the advertising, promotion, and publicity of the Competition and otherwise as stated in these Official Rules (as solely determined by Sponsor). 3. VOTING & COMPETITION (A) General: The voting phase of the Competition shall be separated into two categories consisting of Fan Voting and Judges Voting as detailed below. LIPN will feature a minimum of one (1) to three (3) bands once per week or two weeks on the LIPN website during the Competition phase. For each band entered into the Competition, fan voting will commence the Sunday that the respective band is first featured on the LIPN website and the voting shall continue for two calendar weeks. After the calendar period of open voting for the respective band has expired, the voting shall then be closed with respect to the bands featured during the previous fourteen day period. During the final two weeks of the Competition, voting will recommence for all bands entered into the Competition. (B) Judges Voting: The entries and final competition will be judged by a panel of 3/5 judges selected by the Sponsor. The top five bands with the highest number of votes will be judged using the a scale of 1 to 10 as a combination based on factors including, but limited to (i) originality of music, (ii) musical style and stylization, and (iii) overall presentation. Only the band whose music scores at least a majority of points toward its cumulative score will be declared the winner. Sponsor shall not be responsible or liable for any Entry Materials which cannot, for technical reasons or otherwise, be judged, or posted. (C) Fan Voting: Entry Materials from bands will be posted on the web site’s voting page. To cast a vote, a fan must register on the LIPN website by providing a contact e-mail address and will need to verify his or her vote via a confirming link sent to his or her personal e-mail address. Failure to click on the confirming link will result in the non-tabulation of his or her respective vote. Visitors to the web site may access the Competition page and then vote for the band’s Entry Materials the voter deems most characteristic of a star quality band. There is a limit of one vote per fan per week. The same parameters for username and passwords for bands (stated above in 2 (A) will be applicable for fan voters. Votes posted more than once per week by fans will be deleted by LIPN. LIPN reserves the right to record votes in any way possible to preserve the security of the network and integrity of the competition including IP address of voters, CAPTCHA (Completely Automated Public Turing Test to Tell Computers and Humans Apart), or any other method it deems necessary. (D) Duration of Competition Phase: On Sunday, 1/7/07 and continuing on each successive Sunday thru 6/24/07, each Band’s Entry Materials will be displayed and broadcast on the LIPN web site and fans can register and log in to vote respectively for his or her choice. 4. CONDITIONS FOR ALL PRIZES: Expenses not stated are the sole responsibility of the winners. Prizes cannot be substituted, assigned or redeemed for cash, but Sponsor reserves the right to substitute any prize (or portion of a prize) with one of equal value should that prize (or portion) become unavailable for any reason. If any winner cannot or does not accept a prize as stated, that prize will be forfeited in its entirety and time permitting awarded to an alternate winner. All income and other taxes on prizes are solely the responsibility of the winners. 5. GENERAL CONDITIONS: By participating each band and the individual members of each band release, discharge and agree to hold harmless Sponsor, and its respective, parent, subsidiary and related companies, advertising and promotion agencies, and all of their respective employees, officers and directors, representatives and agents, and judges and against any and all claims, losses or damages of any kind (whether due to negligence or otherwise), including personal injury, death, and/or property damage, and/or breach or failure of any representation or warranty, and/or contract rights, and/or infringement of Intellectual Property rights such as but not limited to, copyright, trademark/trade name, and/or rights of publicity or privacy, defamation, slander, or libel, or portrayal in a false light, arising, in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize or participation in this Competition, or participation in the Competition related activity or travel related activity, and (b) winning bands (those which advanced to the live Competition) and the individual members of each winning band, by acceptance of prize, except where legally prohibited, grant permission, in perpetuity, for Sponsor and those acting pursuant to Sponsor’s authority to use his/her name, photograph, voice and/or likeness, and videos, recordings, prize information, and Entry Materials (and notwithstanding anything to the contrary in these Official Rules license the use of the Entry Materials which may be altered, changed, modified, edited, used alone, together or with other works, and/or used in distorted, illusory or composite form, as solely determined by Sponsor) for advertising, trade and promotional purposes without further compensation, at any times or time, in all media now known or hereafter discovered world wide and on the Internet without notice or review or approval. All Entry Materials will be deemed a work made for hire under the copyright laws of the United States, but if it cannot be so deemed, then each band and the individual members of each band irrevocably sells, assigns and transfers to Sponsor all of his/her right, title and interest in and to his/her Entry Materials, including but not limited to all copyright and trademark rights, in the United States and worldwide, therein, for valuable consideration, the receipt and sufficiency of which is hereby acknowledged. Upon request of Sponsor, each winning band and the individual members of each band shall execute and deliver such additional instrument of assignment, as may be solely deemed by Sponsor, reasonably necessary to establish the ownership of record of the right, title and interest in and to the Entry Materials and of the copyrights transferred hereunder in favor of Sponsor, that the winning band and the individual members of each band may now or later have; and to record and perfect same. Should Sponsor fail to request the said assignment as stated, that shall not be deemed a waiver of Sponsor’s rights and Sponsor may at a later time request the transfer and/or assignment, and each such winning band and the individual members of each band agrees to comply with any such request. INFORMATION PROVIDED IS SUBJECT TO THE PRIVACY POLICY ON THE LIPN WEB SITE. TO ACCESS AND READ THE POLICY, GO TO THE WEB SITE AND CLICK THE PRIVACY LINK. Any dispute concerning the Competition will be governed by the laws of the State of New York and adjudicated therein. 6. LIABILITY LIMITATIONS: Sponsor is not responsible for lost, late, misdirected, illegible, incomplete, postage due or non-delivered mail, Entry Materials, votes, entries or e-mail; or for interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), web site, telephone or other connections, availability or accessibility, or miscommunications, or failed computer, satellite, telephone or cable transmissions, or lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, or technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or Entry Materials, votes, or other information or the failure to capture, or loss of, any such information. Persons who tamper with or abuse any aspect of this Competition, as solely determined by the Sponsor, will be disqualified. Any use of macro or similar software to affect voting will void all such entries and votes by such methods, and disqualify any entrant or voter using such methods. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Competition or downloading materials from or use of the web site. Should any portion of the Competition be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention, technical failures or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries or votes, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Competition, and select the winners from entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by web site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Competition, and assume no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use of this web site. In case of dispute, Entry Material, entries and votes will be declared entered and/or made by the authorized person under whose username and password it was entered or made. IN NO EVENT WILL SPONSOR BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEBSITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID WEBSITE.
